Young Person, Parent and Carer Privacy Notice
This document sets out the basis on which PAC uses personal information about you and, in some cases, your family and friends, while providing therapeutic services to you.
A copy of this privacy notice is being made available to you because you have entered into an agreement with PAC under which we will provide you with therapy and support. PAC is responsible for deciding how we hold and use personal information about you. This document explains how and why your personal information will be used.
PAC will look after personal information you share with us
We will comply with data protection law and principles, which means that your data will be:
- Used lawfully, fairly and in a transparent way.
- Collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.Relevant to the purposes we have told you about and limited only to those purposes.
- Accurate and kept up to date.
- Kept only as long as necessary for the purposes we have told you about.
- Kept securely.
What information do we hold about you?
PAC will collect, store, and use the following categories of personal information about you and, where indicated, your parent(s) and other carers:
Information about you:
- Your name, title, address, telephone number and date of birth;
- Your school address;
- Details relevant to the therapy you have received, including the dates of your sessions, brief case notes, assessments, review reports and ending report; and
- Notes and information from meetings we attend about you, including [TAC, TAF meetings] and meetings at school.
The information we hold about you may include the following “special categories” of more sensitive personal information:
- Information about your race or ethnicity, religious beliefs and sexual orientation;
- Information about your health, your mental health and any medical conditions, including your medical records.
- Information about criminal convictions and offences.
Information about your parent(s) and other carer(s):
- Name, title and contact details.
How will we collect your personal information?
We will collect personal information about you, your parents and other carers from the following sources:
- You, your parent(s) or other carer(s).
- Your school.
- Your GP or other professional(s) who refer you to PAC for therapy.
How will we use information about you?
We will use the personal information, including the sensitive personal information, we collect about you to
- provide you with appropriate support and therapy;
- keep appropriate records of the therapy sessions and case notes; and
- comply with legal or regulatory requirements.
We will use the personal information we collect about your family and friends to make sure that, where necessary, they agree to the therapy being provided to you.
Why we might share your personal information with third parties
You are entitled to confidentiality within the confines of your session at PAC. Your personal Information will not be shared unless you have agreed to it or the court directs PAC to disclose it. This is an essential part of therapy and means that you can feel safe to share whatever you might need to without worry about what others will think or say.
The only exception to this is where a therapist may have concerns about your safety, or the safety of someone else, due to something that has been shared. At the beginning of your therapy, the therapist will explain that in an instance where they deem you, or someone else, to be at significant risk of harm, they would need to share this information with the appropriate person. This could be a parent or carer, school or appropriate outside agency. You will be informed of this and included in the discussion as much as possible.
With your consent, we might share your information with the following third parties to ensure that the therapy PAC provides is provided in addition to other support services you need:
- Your GP or other provider of medical or mental health services.
- Your school.
- Other professionals who are working with you.
We will take appropriate security measures to protect your personal information in our communications with these third parties. These third parties process your personal data for specified purposes. They will be able to give you more information about how they use your personal data if you have any questions.
Data security
We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a legitimate need to use it or who are using it in your vital interests.
We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.
How long will we keep your information?
We will keep your personal information for as long as we are providing therapy to you. After your therapy has ended, we will securely store your information for a minimum period of 7 years. In certain circumstances the law requires us to keep your information for longer, up to 75 years if you are CLA.
When we no longer need to keep your personal information, we will securely destroy it in accordance with applicable laws and regulations.
Your rights in connection with personal information
Under certain circumstances, by law you have the right to:
- Request access to your personal information. This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
- Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
- Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below).
- Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your situation which makes you want to object to processing on this ground. It is very unlikely that PAC will use your personal information in this way.
- Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.
- Request the transfer of your personal information to another party.
If you want to review, verify, correct or request erasure of your personal information, object to the processing of your personal data, or request that we transfer a copy of your personal information to another party, please contact the Chief Executive in writing.
Right to withdraw consent
If you provide consent for us to share your personal information with other professionals, you have the right to withdraw your consent for processing for that purpose at any time. To withdraw your consent, please contact the Chief Executive. Once we have received notification that you have withdrawn your consent, we will no longer involve those other professionals in your therapy or support.
This does not affect our obligation to share information for safeguarding purposes where we deem you, or someone else, to be at significant risk of harm.
